1.Our Position & Core Philosophy

MoxSend exists to make legitimate, targeted B2B outreach land directly in the primary inbox — not to industrialize unsolicited spam. Sender deliverability is a shared ecosystem resource: abusive sending practices damage inbox placement for every customer on the platform.

• Zero Tolerance: Strict adherence to anti-spam policies is a mandatory condition of accessing the MoxSend platform.
• Dual Enforcement: Policy compliance is enforced via automated machine learning telemetry, deliverability heuristics, and manual compliance review.
• Incorporation into Terms: This Anti-Spam Policy is fully incorporated into our Terms of Service.

2.Statutory Laws You Must Comply With

You are strictly required to comply with all applicable electronic messaging and commercial communications laws, including:

• United States: The CAN-SPAM Act (truthful headers, clear sender identification, valid postal address, and prompt opt-out processing).
• European Union & United Kingdom: The EU General Data Protection Regulation (GDPR), UK GDPR, and Privacy and Electronic Communications Regulations (PECR).
• Canada: Canada's Anti-Spam Legislation (CASL).
• Australia: The Spam Act 2003.
• India: The Digital Personal Data Protection Act 2023 and Telecom Commercial Communications Customer Preference Regulations (TCCCPR).
• GCC Region: Commercial communication and cybercrime regulations of the United Arab Emirates (TDRA) and Kingdom of Saudi Arabia (CST / PDPL).

Where legal requirements conflict, the stricter deliverability and consent standard applies to your workspace.

3.Consent & Lawful Basis Standards

• Demonstrable Lawful Basis: You must maintain a verifiable legal basis for contacting every lead (such as express consent, an active business relationship, or a documented legitimate interest assessment relevant to the recipient's corporate function).
• Relevance & Proportion: Outreach must be individually researched, professionally relevant, and proportionate. Mass unsegmented blasts are strictly prohibited.
• No Deceptive Consent: Consent acquired through pre-checked checkboxes, misleading opt-ins, or obfuscated terms is void under this Policy.

4.Prohibited Lists & Sourcing Practices

• No Purchased or Rented Lists: Uploading bought email databases or third-party lead batches is strictly prohibited.
• No Web Scraping / Harvesting: Automated scraping of email addresses from public directories or social graphs without verifiable consent is banned.
• Stale List Re-Verification: Contact lists older than 90 days must be verified through MoxCheck prior to campaign activation.
• No Role Account Carpet-Bombing: Blasting generic distribution inboxes (e.g., info@, admin@, support@, sales@) is forbidden.

5.Message & Content Requirements

• Accurate Header & Identity: Senders must not spoof headers, disguise domains, or use misleading "Re:" or "Fwd:" subject lines.
• Mandatory 1-Click Unsubscribe: Every outreach email must include a clear, operational unsubscribe link that automatically suppresses future sends across your workspace.
• Prompt Opt-Out Processing: Opt-out requests must be honored immediately and within a maximum of ten (10) business days.
• Physical Postal Address: Emails must include a valid corporate postal address where required by CAN-SPAM or local law.
• Prohibited Content: No deceptive links, malware attachments, phishing attempts, adult content, or fraudulent business offers.

6.Platform Enforcement & Safety Thresholds

MoxSend maintains real-time monitoring of domain health and sender metrics, automatically enforcing the following safety ceilings:

• Hard Bounce Ceiling (2.0%): Campaigns exceeding a 2.0% bounce rate are automatically paused; MoxCheck list cleansing is required to resume.
• Spam Complaint Ceiling (0.3%): Workspace spam complaint ratios approaching 0.3% trigger automatic sending throttling or administrative suspension.
• MoxWarm Pacing Compliance: Senders must adhere to automated warm-up ramp curves; attempting to artificially bypass pacing limits constitutes a material breach.

7.Consequences of Violation

In the event of an anti-spam violation, MoxSend may execute the following remedial actions depending on severity:

• Sending Throttling: Immediate reduction of daily sending limits and concurrency across connected mailboxes.
• Campaign Quarantine: Freezing live sequence queues pending list audit and proof of lawful basis.
• Mandatory Verification: Requiring comprehensive list re-scrubbing via MoxCheck at the user's expense.
• Account Termination: Immediate permanent termination of workspace access and forfeiture of unused credits without refund.
• Provider & ISP Reporting: Reporting malicious or unlawful activity to mailbox providers, reputation registries, and regulatory bodies.

8.Reporting Spam & Abuse

• Dedicated Abuse Desk: Anyone receiving unwanted communications originating from MoxSend may report it to hello@moxsend.ai with the email headers.
• Global Domain Suppression: We investigate all reports promptly and can apply domain-wide suppression to protect recipients.

9.Recipient Protections & Rights

If you are a recipient of an email sent by a MoxSend user:

• Instant Opt-Out: Clicking the unsubscribe link in the email footer suppresses your address from all future sequences from that workspace.
• Direct Abuse Report: You can forward the email to hello@moxsend.ai for immediate investigation.
• Privacy Rights: Our Privacy Policy outlines how we assist sending controllers with GDPR and PDPL data rights fulfillment.
